Who’s Playing Tonight
Terms of Service

These terms apply to the Who’s Playing Tonight service and its paid promotion feature (“Promo”). By using the service or submitting a Promo, you agree to these terms.
1. Listings and third-party information
Schedules are compiled from venue and ticketing sources and can change. We do not operate the listed venues, sell their tickets, or guarantee that a performance, time, lineup, price, or external link is complete or current. Confirm details with the venue before traveling or purchasing.
2. Promo overview
- A Promo highlights an event in the selected region and event date.
- Placement, timing, visibility, impressions, clicks, and sales are not guaranteed.
- Availability is limited, and we may limit or decline promotions by venue, date, region, content, or capacity.
3. Submission and review
Promos may be reviewed by automated systems and human reviewers for accuracy, quality, policy compliance, and safety. Approval does not guarantee publication. Payment is required before publication, and we may edit, restrict, reject, expire, or remove a Promo at any time.
4. Eligibility and authority
You must be at least 18 or the age of majority where you live. You represent that you are authorized to promote the event and have permission to use every submitted name, logo, image, link, and other element.
5. Your content and license
You are responsible for accurate, lawful content. You grant Who’s Playing Tonight a non-exclusive, worldwide, royalty-free license to host, use, display, reproduce, format, resize, crop, adapt, and promote submitted content for operating and marketing the service. We may share it and related contact information with providers working on moderation, hosting, analytics, payments, support, and communications.
6. Pricing, payment, and refunds
Prices are shown before purchase and may change. Apple or Google processes in-app payments, and Stripe processes website payments. The applicable provider’s terms and refund rules apply. We do not store payment-card details. Sales are final except where law or platform policy requires otherwise. A rejection, removal, event change, cancellation, or expiration does not automatically qualify for a refund. If a Featured Gig slot becomes unavailable during website checkout, we may automatically cancel and refund that payment.
7. Prohibited content
You may not submit illegal, fraudulent, deceptive, infringing, unsafe, hateful, harassing, discriminatory, sexually explicit, violent, malicious, phishing, spam, or unrelated material; false affiliations; or regulated products and services without prior approval.
8. Service changes and termination
We may change, suspend, or discontinue all or part of the service and may limit access for violations, risk, abuse, technical needs, or legal requirements. You remain responsible for keeping Promo and event details current.
9. Disclaimers and liability
The service is provided “as is” and “as available” to the maximum extent allowed by law. We are not responsible for event cancellations, venue changes, inaccurate third-party details, third-party sites, or ticket transactions. We disclaim implied warranties, and our total liability for a Promo claim will not exceed the amount paid for that Promo. We are not liable for indirect, incidental, special, or consequential damages where the law permits.
10. Indemnification
You agree to indemnify and hold harmless Who’s Playing Tonight and its owners, workers, contractors, and affiliates from claims and expenses arising from your Promo, submitted content, rights violations, misleading statements, unlawful conduct, or breach of these terms.
11. Changes and contact
We may update these terms and will post the revised effective date. Continued use after an update means you accept the revised terms. Questions can be sent to whosplayingtonightnyc@gmail.com.
